OGDEN, Utah, March 14, 2022 (Gephardt Daily) — A suspected drunk driver was arrested in Ogden on Sunday after being found unconscious in a car with the engine running and with an unrestrained toddler trying to wake him up.
Before officers arrived at the scene near 1300 South and Washington Blvd., the 2-year-old girl had attempted to climb out of a vehicle window, said a witness who remained at the scene.
The witness reportedly feared “that the minor fell on the street”, says a probable cause statement filed on suspect Dominick Richard Ludwick, 24. “Officers had to wake up Nick, who was in the driver’s seat of the driving vehicle. ”
Police detected the smell of marijuana in the vehicle, the statement said.
“Nick had bloodshot eyes that were bright and his eyelids felt heavy. Nick passed standard field sobriety tests” and failed horizontal gaze nystagmus
6/6 Clues and showed Vertical Gaze Nystagmus in both eyes,” the statement read.
“Nick also had Lack of Convergence (LOC) where the eyes did not meet. His left eye remained forward as his eye had crossed. LOC is consistent with marijuana use, as well as eye redness and the drooping of his eyes.
Ludwick failed further tests and the child’s mother came to pick her up. Police discovered that the toddler’s car seat was unbuckled.
The suspect refused to cooperate with a blood test, then granted clearance, then revoked his clearance, the statement said. A warrant was granted to obtain his blood.
Ludwick was imprisoned for:
- Endangerment of a child, a third degree felony
- Driving under the influence with a minor in the vehicle, a class A misdemeanor
- Denying a chemical test, a class B misdemeanor
Ludwick’s bail was set at $10,000. He was released from Weber County Jail.
